Public authorities have a range of duties under the Equality Act 2010. When carrying out their functions, they must have due regard to the need to eliminate unlawful discrimination and to advance equality of opportunity.

Originally covering only race, gender and disability, the general public sector duty now also covers age, religion and sexual orientation.

Increasingly, the higher courts are requiring authorities to reconsider key decisions where no risk assessment was carried out before going ahead.

Emphasis is now placed on the practical carrying out of the duties rather than simply getting the paperwork in order.
